UNITED STATES CONTINGENT FEE SYSTEM

Our firm enthusiastically and exclusively represents our clients based upon the contingent fee system. Approximately one hundred years ago, it was recognized that many U.S. citizens could not afford to pay an attorney in order to be represented in a claim against companies or other people who wrongfully injured them. Unlike attorneys who practice in other areas of law, our attorneys accept cases and are paid fees based upon an agreed percentage of the total amount of funds recovered by trial or settlement.

It is our philosophy that an injured person or a surviving family member of someone fatally injured should not have additional financial burdens placed upon them in order to pursue their rightful claims. Our fees are incurred only when the individual client's claim is successfully resolved at Trial or by settlement.

Typically, our firm's contingent fee is one-third (33.3%) of the total recovery, in addition to reimbursement for costs paid by us in prosecuting the client's claim. The contingent fee for workers' compensation and occupational diseases claims is twenty percent (20%) of the total recovery, in addition to the cost reimbursement. "Costs" are actual bills incurred for each claim, including filing fees, court reporter costs, and trial exhibits. The ethical rules of the Illinois Supreme Court require each attorney in Illinois to separate their fees from their costs and to itemize those costs when reimbursed from the resolution of a case.

ABOUT THE FIRM

Scott B. Gibson was an Illinois State Prosecutor in the State's Attorney's Office for Lake County, Illinois. For four years, he served as the lead or sole prosecutor of thousands of offenses, including dozens of jury trials. Mr. Gibson tried to verdict some of the most notorious and wildly publicized criminal prosecutions at that time, and personally tried a dozen felony jury trials to verdict the last year of his prosecutorial career including jury verdict convictions for murder, rape, child sexual assault, and major drug dealing.

Since leaving the prosecutors’ office in 1987, Scott B. Gibson had and continues to work exclusively for plaintiffs as a personal injury lawyer with offices in Waukegan and Chicago, Illinois, and has successfully represented a thousand clients throughout the state of Illinois, Wisconsin, and in federal court.

 

In 1997, Megan Chadwick, after having practiced for years as a personal injury attorney in other law firms, joined the firm as “of counsel.”
